Accidents at natural pools and viewpoints: who is liable?

Natural pools, hot springs and viewpoints in the Azores draw thousands of visitors in summer. When someone falls, slips or drowns, the question arises: who is liable — the municipality, a private operator, or no one?

This article complements accidents on commercial tourist activities; here we focus on free or public-access sites.

Not every accident leads to compensation

Portugal does not automatically compensate every accident. You must analyse:

• Who manages the site (State, municipality, private);
• Whether there was negligence (signage, maintenance, barriers);
• Whether the risk was visible and avoidable;
• Whether the visitor breached clear rules (fences, warnings, hours).

Many viewpoints and pools involve natural risk — uneven ground, slippery rocks, rough sea. That does not exclude liability, but limits it.

Natural pools and hot springs

At sites such as Furnas, Poça da Dona Beija or coastal pools:

• If the site is managed (ticket office, staff, internal rules), the operator may be liable for failures in maintenance, supervision or information;
• If access is free, public liability depends on duties of signage and minimum safety — complex under administrative law;
• Drownings require analysis of rescue measures, sea warnings and the victim's conduct.

Unsupervised viewpoints and trails

Falls at viewpoints without rails or with degraded surfaces raise debates on duty to fence vs. disproportionate cost. Each case depends on expert evidence and case law. Photos at the time of the accident (surface, signage) are decisive.

What to do after the accident

• Seek medical care — even for "minor" injuries;
• Photograph the site, conditions and warnings (or lack of them);
• Identify witnesses;
• Report the incident to the site manager, if any;
• Keep medical bills and proof of lost earnings.

Tourists who have already left

Proceedings can continue remotely — notification to the liable entity, travel insurance, court action in Portugal. Limitation periods apply; seek advice early.
