Experience tourism in the Azores — jeep tours, whale watching, water parks, diving, guided trails — peaks in summer. When an accident happens, the immediate questions are: who is liable and how to obtain compensation?
This article covers accidents on tourist and leisure activities, distinct from road traffic accidents (which have their own rules).
Operator liability
Anyone running a commercial activity — tour company, marina, park — must ensure participants' safety within the limits of accepted risk. Poor equipment maintenance, inadequate briefing, reckless guides or overcapacity can give rise to civil liability.
The injured client may claim personal injury, medical expenses, lost earnings and, depending on the case, non-pecuniary damage.
The role of insurance
Tour operators should hold adequate liability insurance. In practice, compensation often goes through the company's insurer — which requires reporting the claim, documenting injuries and sometimes resisting low offers.
If the operator is uninsured or insolvent, recovery is harder — but not always impossible.
What to do right after the accident
- Seek medical care and keep reports, prescriptions and scans;
- Photograph the scene, equipment and conditions;
- Identify witnesses and ask for contact details;
- Insist on a written incident record with the operator (many try informal settlement);
- Do not sign generic releases on the spot, especially in a language you do not fully understand.
"Minor" injuries that worsen
A slip on a pier or twist on a trail may seem trivial and later cause permanent sequelae. Document clinical progress in the following weeks — for compensation purposes, undocumented harm weakens the claim.
Tourists who have already returned home
Many visitors are no longer in the Azores when they assess severity. Proceedings can continue remotely: insurer notification, expert reports, settlement or court action in Portugal. Limitation periods apply — do not delay because you are abroad.
